Introduction
These Terms of Service ("Terms") govern your use of digistudio.dev and any services provided by DigiStudio ("we", "us", or "our"), including web design, development, e-commerce, and maintenance services. By using our website or engaging our services, you agree to these Terms.
Specific project details, pricing, and deliverables are typically confirmed separately in a proposal, quote, or contract. Where a signed agreement conflicts with these Terms, the signed agreement takes priority.
Our Services
We offer the design and development of websites and web applications, mobile applications, desktop software, APIs and integrations, as well as infrastructure, technical support, maintenance and modernisation services, as described on our Services page. We also publish our own software (including DigiStock, DigiPlan and DigiTap), whose use may be subject to specific terms published on their respective websites. The exact scope of your project will be defined in a written proposal or agreement before work begins.
Project Process & Client Responsibilities
To keep your project on track, we ask that you:
- Provide accurate information, content, and access needed to complete the work
- Respond to requests for feedback or approval in a timely manner
- Review deliverables and provide revision notes within the agreed timeframe
- Ensure any content, images, or trademarks you provide do not infringe on third-party rights
Delays in feedback, content delivery, or approvals may affect project timelines and are not considered a failure on our part to meet agreed deadlines.
Payment Terms
Pricing and payment schedules are set out in your project proposal or invoice. Unless otherwise agreed in writing:
- A deposit may be required before work begins
- Remaining balances are due according to the milestones or schedule agreed at the start of the project
- Late payments may result in paused work until the account is settled
- Prices for ongoing services, such as maintenance plans, are billed on a recurring basis and may be updated with reasonable notice
Revisions & Approval
Most projects include an agreed number of revision rounds, as specified in your proposal. Additional revisions or changes outside the original scope may be billed separately as extra work, and we will always confirm this with you before proceeding.
A project is considered complete and approved once you confirm sign-off, or if no feedback is received within a reasonable period after final delivery.
Intellectual Property
Once a project is paid in full, ownership of the final deliverables (such as the website design and custom code built specifically for you) transfers to you, unless otherwise agreed. This does not include:
- Third-party tools, plugins, themes, or libraries used in the build, which remain subject to their own licenses
- Our internal frameworks, boilerplate code, or reusable components, which we retain the right to reuse across other projects
- Our own portfolio rights — we may showcase completed work in our portfolio and marketing materials unless you request otherwise in writing
Warranties & Disclaimers
We aim to deliver high-quality, functional work and will fix bugs directly related to our development within a reasonable warranty period following delivery, as specified in your proposal.
Our services are provided on an "as is" and "as available" basis. We do not guarantee that your website will be free of every possible error, that it will achieve specific business results (such as search rankings or sales), or that third-party services we integrate with (hosting, payment gateways, plugins) will be uninterrupted or error-free.
Limitation of Liability
To the fullest extent permitted by law, DigiStudio will not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website, including loss of profits, data, or business opportunities.
Our total liability for any claim related to a project is limited to the amount you paid us for that specific project in the twelve months preceding the claim.
Termination
Either party may terminate a project agreement with written notice, as outlined in your specific contract. If a project is terminated before completion, you will be billed for work completed up to that point, and any deposit paid is generally non-refundable unless otherwise agreed.
We reserve the right to suspend ongoing services, such as hosting or maintenance, if payment is significantly overdue and remains unresolved after reasonable notice.
Third-Party Services
Projects may rely on third-party services such as hosting providers, domain registrars, payment gateways, or plugin developers. We are not responsible for outages, price changes, or policy changes made by these third parties, though we will do our best to help you navigate them.
Governing Law
These Terms are governed by the laws of Morocco, without regard to conflict of law principles. Any disputes arising from these Terms or our services will be handled in accordance with applicable local law, unless otherwise agreed in a specific project contract.
Changes to These Terms
We may update these Terms from time to time. Changes will be reflected by the "last updated" date above. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
